Legal Commentary on the Alien Act of Switzerland

This book volume comments article-by-article the text of the new Swiss Alien Act, which entered into force on 1 January 2008.

• PhD student Rosa Losada commented on Article 3, which defines the conditions for admission to the Swiss labor market. She also commented on Article 39, on employment of cross-border commuters.

• Marion Panizzon commented on Art. 100, a framework provision listing all migration agreements, which the Swiss government can conclude in the field of migration. The commentary for Art. 100 summarizes contemporary Swiss practice relating to agreements on readmission, visa facilitation, residency, labor, cross-border supply of services and status of diplomatic personnel. It also describes migration partnerships, which are a new and comprehensive type of bilateral or multilateral agreement incoporating into a single treaty template the different policy areas impacting on migration. A first such migration partnership has been concluded with the countries of the Western Balkans.
